Department of Homeland Security Releases New I-9 (Employment Verification) Form

To: All HRMS/HR Liaisons/UHR Staff
On November 6, 2007, the Department of Homeland Security released a new Form I-9 (Employment Verification).
Compliance & Immigration Services (CIS) has placed this new form on our website, www.hrs.virginia.edu/cis.html, in our Forms Index and it is now available for immediate use. All other versions of the I-9 form should be discarded.
All departments must begin using the new I-9 form no later than December 7, 2007. After December 7, 2007, this will be the only version accepted by CIS. All other versions will be considered obsolete after that date.
Changes to List A on the new form:
The new form removes the following five documents from List A, the list of documents acceptable to prove employee identity and work authorization:
- Certificate of U.S. Citizenship (Form N-560 or N-561)
- Certificate of Naturalization (Form N-550 or N-570)
- Alien Registration Receipt Card (Form I-151)
- Unexpired Re-entry Permit (Form I-327)
- Unexpired Refugee Travel Document (Form I-571)
In addition, one document has been added to List A:
- Unexpired Employment Authorization Document (I-766)
All employment authorization documents with photographs in circulation are now included in one item on List A. These are:
- I-688, I-688A, I-688B, I-766
The instructions for Section I of the I-9 have been changed to say that an employee is not obligated to provide a social security number unless he or she is employed by an employer who participates in E-Verify, a web-based employment verification system (U.Va. does not use E-verify). The I-9 instructions on photocopying the form now include information about electronic signatures and retention.
We have been advised that a new version of the I-9 form will be issued in 2008. To ensure that you are always using the most recent version of the form, please bookmark our website link to the I-9 form.
